Calls for President Joe Biden to resign surfaced on Thursday after special counsel Robert Hur released a report on the findings from his investigation into Biden’s handling of classified materials.

While the report agreed that Biden “willfully retained and disclosed classified materials after his vice presidency when he was a private citizen,” it absolved him of any criminal responsibilities, as prosecutors concluded that they would not be filing any criminal charges.

According to the report, one of the reasons prosecutors decide not to press charges against Biden is the decline in his mental capacity.

As written in the report, “Mr. Biden’s memory was significantly limited, both during his recorded interviews with the ghostwriter in 2017 [with whom he shared classified materials], and in his interview with our office in 2023.”

Pointing out that Biden would come off as “a sympathetic, well-meaning, elderly man with a poor memory” to a prospective jury if charges are filed against him, prosecutors concluded it would be “difficult to convince a jury that they should convict him — by then a former president well into his eighties — of a serious felony that requires a mental state of willfulness.”

Since the release of the long-awaited report, Biden has been urged to resign, as many on the right have pointed out that he is not fit for office.

One of those at the forefront of the resignation calls include former President Donald Trump, who wrote on social media, “THIS HAS NOW PROVEN TO BE A TWO-TIERED SYSTEM OF JUSTICE AND UNCONSTITUTIONAL SELECTIVE PROSECUTION! The Biden Documents Case is 100 times different and more severe than mine. I did nothing wrong, and I cooperated far more.”

He went further, writing, “What Biden did is outrageously criminal – He had 50 years of documents, 50 times more than I had, and ‘WILLFULLY RETAINED’ them. I was covered by the Presidential Records Act, Secret Service was always around, and GSA delivered the documents. Deranged Jack Smith should drop this Case immediately. ELECTION INTERFERENCE.”

Top House Republicans also weighed in on the issue, with House Speaker Mike Johnson (R-LA), House Majority Leader Tom Emmer (R-MN), House Majority Whip Steve Scalise (R-LA), and Conference Chairwoman Elise Stefanik (R-NY), releasing a joint statement calling the special counsel’s finding “deeply disturbing.”

“Among the most disturbing parts of this report is the Special Counsel’s justification for not recommending charges: namely that the President’s memory had such ‘significant limitations’ that he could not convince a jury that the President held a ‘mental state of willfulness’ that a serious felony requires. A man too incapable of being held accountable for mishandling classified information is certainly unfit for the Oval Office,” the statement read.

Johnson also took to X to point out that Biden is not fit for office.

“The President’s press conference this evening further confirmed on live television what the Special Counsel report outlined. He is not fit to be President,” he tweeted.

Sen. Mike Lee (R-UT) also tweeted, “It is sad that it got to this point, but America desperately needs capable leadership in the White House. The safety of our country is at stake.”

Sen. Ted Cruz (R-TX) wrote, “The US Department of Justice formally laying out evidence that the sitting President of the United States IS NOT COMPETENT TO STAND TRIAL. He cannot remember when he was Vice President, but this man has the nuclear codes….”
