The Biden administration has launched an investigation into California regarding a controversial law enacted by Governor Gavin Newsom that prevents schools from implementing policies requiring parental notification when students express desires to change their gender identity.

The law, which Newsom signed into effect last year, came in response to several conservative school districts that had established protocols mandating schools to inform parents about their children’s gender-related decisions. The districts’ policies stemmed from worries that schools were potentially encouraging gender transitions while keeping parents uninformed, citing student privacy concerns.

Public opinion data indicates that an overwhelming majority of California residents support parents’ rights to be informed about their children’s gender-related decisions.

When questioned about this issue by Breitbart News during the Republican presidential primary debate’s spin room in 2023, Newsom attempted to deflect by downplaying the significance of transgender-related matters.

The U.S. Department of Education made its investigation public on Thursday, stating: “Today, the U.S. Department of Education’s Student Privacy Policy Office (SPPO) launched an investigation into the California Department of Education (CDE) for alleged violations of the Family Educational Rights Privacy Act (FERPA). FERPA gives parents the right to access their children’s educational data. The California Department of Education has allegedly abdicated the responsibilities FERPA imposes due to a new California state law that prohibits school personnel from disclosing a child’s “gender identity” to that child’s parent.

SPPO has reason to believe that numerous local educational agencies (LEAs) in California may be violating FERPA to socially transition children at school while hiding minors’ “gender identity” from parents. Given the number of LEAs that appear to be involved, SPPO is concerned that CDE played a role, either directly or indirectly, in the widespread adoption of these practices, which appear to be required by the recently enacted California Assembly Bill 1955.”

The federal FERPA legislation, overseen by the Department’s SPPO, ensures parents can access their children’s educational records, request modifications to these records, and maintain control over the disclosure of personal information within these records, with certain exceptions.

Recently, Newsom has shown signs of moderating his stance on transgender issues, telling conservative commentator Charlie Kirk that he opposes allowing biological males to compete in women’s sports – a position that contradicts current state policies.
